In 2022, Berens had the unique opportunity and honor to argue before the Washington State Division 2 Court of Appeals.  Darrin Bailey briefed the legal issue being argued, which centered on the duty a landlord owed to an invitee.  Berens delivered oral argument.  In this case, the invitee was a Soldier who was shot and killed on the landlord’s property.  The evidence revealed extensive law enforcement responses to the property in question and a history of inaction by the landlord.  Mike Berens and Darrin Bailey prevailed on the legal issue before the appellate court.
